A Letter From Me To You

Having worked for over twenty years as an employment lawyer, I can tell you this: leaving your job with a well-negotiated settlement agreement is your strongest move in nearly every situation.

Consider the alternatives.

If you’re facing redundancy, your employer may legally dismiss you with minimal payment if you haven’t reached the two-year mark for redundancy and unfair dismissal protection. Without a settlement agreement, you could be dismissed with nothing more than a bare payout and little legal recourse. A settlement agreement, however, offers you a better payment and a guaranteed reference, giving you solid support as you move forward.

If you are over the two-year threshold, you could be made redundant on the meagre terms provided by law or performance managed out of the business through the use of a performance improvement plan. Either way, you will almost certainly secure better terms under a settlement agreement.

Perhaps you have strong grounds for a claim against your employer. For example, you may be the victim of discrimination or harassment. If so, you’re in an ideal position to negotiate a substantial settlement, receiving payment within weeks rather than enduring a lengthy, stressful, and costly tribunal process, which can drag on for two years before a final hearing.
